A young man who sold Viagra to a man in Newcastle has been sentenced to three years of hard labour after being caught selling it to a young man in the UK.
David Thomas-Kearns was sentenced today at Newcastle Crown Court to three-and-a-half years in prison, suspended for one year and ordered to pay a $2.5 million fine.
The court heard he was working at a drugstore for a year in the first half of the year when the man asked him to try for a stiffener for the first time in his life. He decided to buy a pack of Viagra tablets, which he had never used before, in Newcastle.
Thomas-Kearns was also convicted of possession of a controlled substance, possession of a controlled substance with the intent to supply it to the defendant, and possession of a controlled substance with intent to supply it to the defendant.
Judge Claire Louth said: "The court was very impressed with the young man's attitude, the way he was selling, and the fact that he did not want to be arrested at the time.
"This is not an isolated incident. Many young men will go to jail for this very reason.
"It was clear that the defendant did not want to be arrested. The court was not impressed by this behaviour on the part of the defendant."
Thomas-Kearns sold Viagra to a young man in Newcastle in the spring of 2004. The man, who was aged in his 20s, was working at a drugstore for a year before buying the tablets on the internet.
A court report showed he had been arrested in February 2004 for selling a large number of drugs, including a large quantity of counterfeit Viagra. He had sold these tablets to another person in a three-month span.
Thomas-Kearns was convicted of possession of a controlled substance, possession of a controlled substance with the intent to supply it to the defendant, and possession of a controlled substance with intent to supply it to the defendant.
